Do You Have to Be Off Work for a Year Before Applying for Disability?

A lot of people wait too long to apply for Social Security Disability because they believe they must be off work for at least a year before they can file.  That is not true. You are not required to wait a year after the date of your injury or disability to apply for benefits.

This confusion is probably caused by a misunderstanding of a different requirement. Social Security does require that your medical condition must be expected to last at least 12 months, or it must be severe enough to result in death. You do not have to already be out of work for a year. You can apply as soon as you stop working or when you cut back your hours sufficiently to be below the earnings limit.

In fact, filing early can help. The sooner you apply, the sooner your claim can start moving through the process. Waiting to apply often just delays the benefits you may be entitled to receive. By applying when your condition first becomes serious enough to prevent full-time work, you are also protecting your filing date and your potential back pay.
